Blocking unemployment claims - Florida leads nation

A report released in September by the National Employment Law Project (NELP) has highlighted the difficult conditions workers in Florida face when trying to file unemployment claims. Through a combination of reactionary unemployment laws and increasingly difficult electronic filing requirements, the state has reduced the percentage of unemployed workers able to claim unemployment insurance (UI) to the lowest in the country.
Fewer than one in eight workers who seek relief through the program are able to collect benefits, a trend that has accelerated over the last four years. In the year spanning June 2014 to June 2015, only 12 percent of Florida’s unemployed received UI compared to a national average of 27 percent.
In August of 2011, the Florida state legislature passed House Bill 7005, which reduced the number of weeks a worker could collect benefits, required new claimants to take an “initial skills test,” and expanded the definition of “disqualifying misconduct.” Extensive documentation of job searches was also introduced, requiring workers to make five job search contacts per week to maintain eligibility. In addition, the law linked the length of time one could collect UI to the state’s unemployment rate, which can fall to as low as 12 weeks if the rate drops to 5.3 percent.
Because of this sliding scale, workers in Florida currently are only able to collect benefits for 14 weeks, down from 26 before the bill’s passage. The law also changed the name of the state’s unemployment program to the Orwellian “Reemployment Assistance Program.”
That bill, along with subsequent legislation, also introduced mandatory electronic filing for most aspects of the UI program. According to the NELP report, “each of these transactions could only be completed online: initial claim filing, registration with the public employment service, posting of an online resume, a 45-question math, reading, and research skills test, and extensive documentation of weekly work-search activity.” Because unemployed workers are less likely to have reliable and convenient internet access, this prevents many workers from being able to make claims in the first place.
Following the bill’s passage, thousands of workers were either unable to file initial claims or had long delays before their first payment. Those with disabilities or limited English-language skills were particularly affected; the report stated that “limited-English-proficient (LEP) persons and people with disabilities were effectively denied access to UI benefits under the new system”.
In 2013 the US Department of Labor’s Civil Rights Center issued an initial determination stating that Florida’s electronic filing requirements had a discriminatory effect on these groups and was in violation of several federal statutes, including Title II of the Americans with Disabilities Act and Title VI of the Civil Rights Act. The state was ordered to take corrective action or face a possible loss of federal funding for UI administration. Since that time, the Florida legislature has done nothing to come into compliance with this order and have instead introduced further eligibility requirements.
The net effect of these laws has been that thousands of workers are barred from collecting the benefits they are lawfully due. According to the report, “from the 12 months ending July 2011 to the same period ending July 2012, average weekly new state UI initial claims in Florida declined by 23 percent, while average weekly state UI first payments dropped by an even greater 40 percent. By comparison, new initial claims and first payments nationwide experienced respective declines of just 9 and 10 percent over the same period.”
The NELP report goes on to state that “between calendar years 2010 and 2014, new claims for benefits in Florida declined by 44 percent compared to 32 percent nationally. During that same period, first UI payments declined by 62 percent in Florida compared to 35 percent nationally. And while average weekly continuing claims dropped by 42 percent nationally, the decline in Florida was 62 percent.”
Since the electronic filing requirements went into effect, the number of workers disqualified from receiving benefits for reasons unrelated to their separation from their job has increased by 300 percent. In the last year over 75,000 workers were denied benefits for “procedural” reasons, compared to less than 18,000 in 2010. This is despite the overall number of claims declining by over 50 percent. From 2010 to 2014 Florida’s official unemployment rate dropped from 11 to 5.7 percent, yet the numbers disqualified for procedural reasons rose by approximately 180 percent to nearly 172,000 per year. Many of the disqualifications were related to failure to adequately document work search history using the online system. In 2014, the report states that the number of workers who were denied benefits for “work search and procedural reporting requirements” was greater than those who received a first payment, with 213,000 denied benefits while 193,400 received their first payment.
Florida ranks second lowest in the country in initial claims, with fewer than four in ten workers receiving an initial payment; the national average is 68 percent. Approximately 62 percent of workers receiving benefits exhaust the program’s 14 weeks of eligibility before finding work. This is the highest rate in the nation.
Additionally, in October of 2013 the state rolled out the 77 million dollar CONNECT system to allow people to file online, creating further obstacles in receiving benefits. The new system is “more complex and requires more adjudications than the prior filing system.” Immediately after the new system was introduced, tens of thousands of workers faced delays of up to four months in receiving their first payment, allegedly due to glitches in the system.
The NELP report found that in the 18 months following the implementation of CONNECT only 64 percent of workers received their first payment in what is considered a timely manner, compared to a federal standard of 87 percent. In the first year of the program, according to the report, “the number of benefit denials resulting from nonmonetary determinations (unrelated to separations) increased by 31 percent (or by roughly 62,800), despite the fact that state UI new initial claims decreased by a little more than 6 percent, first payments decreased by 12 percent, and weekly claims fell by 20 percent. Most notably, denials for reasons related to availability for work and work search more than doubled following the launch of CONNECT, increasing from about 62,400 to 137,700.”
Inevitably, the US Secretary of Labor was forced to intervene, requiring Florida to make the necessary corrections to speed up benefit payments. The CONNECT system has subsequently been subject to multiple legislative hearings and a state audit.

Yes, really. No, I am not vargas. I really want to tell you about this car.
I was going up to Idaho, Montana, Wyoming, and so on, from sunny San Jose, and one car decided to have a broken wheel, and the other needed a new steering rack, so I rented a car. It cost me $237 to rent. Though I am going to add $5 to that value because they gave it to me without a drop of washer fluid and I poured in a jug of it. No low washer fluid light, either.

Now, on the plus side, this car has four wheel disc brakes. It also has a steering wheel that works, a transmission that seems to work, and an engine that can accelerate the car, eventually.
You want to talk specs? Nobody talks specs. It’s a 1.6 liter inline four with about 138 horsepower and 123 lb-ft of torque … I’m not entirely certain how much of it makes it to the wheels. It supposedly weighs under 3000 pound curb weight, but it certainly doesn’t have the pep of a light car.
Exterior is ugly. No way around it. It looks like ass. Interior is not any better. Hard seats, hard everything, cheap plastic crap. What else do you expect for an MSRP of, what, eighteen grand?
Though massive praise to how comfortable the seats are despite appearing and feeling like garbage. I’m serious. I put 53 hours of driving into this car and my back had no complaints. I’m pretty skinny, medium height, and mid-20s, so there is that.
EPA claims 25 mpg city and 30 highway which is… well, truth be told, this is only accurate when cruising at low speed. I mean, at 55 mph in a straight line with no elevation change, it returned like 33 mpg. So around the same as my corvette. At higher speeds, it returned closet to 23 mpg. So around the same as my corvette. If you drive on the highway and you’re looking for a fuel sipper, look elsewhere - it doesn’t do any better than a car with a 5.7 liter supercharged v8.
Yes, it is a city car. And I’ll be telling you exactly why it’s just hot garbage for highways, apart from aggressively mediocre mpg.
First of all, let’s talk speed and acceleration, because that’s what people do. My expectations were tempered by a dozen other econoboxes I’ve driven. This was not the worst. It was, however, almost the worst, beating out only a Nissan Versa Note (hatchback) for worst speeds and acceleration. Its 0-60 is "eventually" - I think it’s rated somewhere around 9 seconds, and after flooring it on an on ramp I think it’s pretty accurate. I mean, this is slow enough that you can floor it onto an on-ramp and the cop behind you is just pissed you’re going so slow because there’s a cop behind you. Honestly, though, you can floor this almost anywhere and almost any time without consequence. Want to pass someone? Floor it. Want to accelerate an extra 4 mph? Floor it. Want to go up hill and not lose speed? Floor it.
A very sensual, sexy car - it advocates threesomes between your foot, the gas pedal, and the floor. Slam it in and keep it there if you want anything to happen.
Passing people on the opposite side of the road was downright scary at times. Double downshift to fourth (I’ll get to that), floor it, begin your pass, finish your pass, upshift back to fifth or sixth. After ten seconds of flooring it in fourth and starting at 65 mph, you should be going about 85 mph.
Though I did manage to get the thing to 110 once, down a really long straight hill, with the pedal floored for over a minute.
Edit : Oh, man, I totally forgot to mention: elevation. This car is really not that bad at sea level, but I was up in the sierras and the cascades and the rockies ... you take this car up to 6, 7, 8 thousand feet, and it just completely and utterly runs out of breath. Like, foot to the floor in 4th gear and it hardly accelerates. I remember up a big hill I had 4th floored for like five minutes and I still lost speed. Not an exaggeration, either, there are some serious mountain passes going south from Glacier to Yellowstone/Teton.
Braking is similarly annoying. Its brake bite and bias is horrendous. You tap the brake a little and nothing happens. You accidentally tap a little further and the entire car lurches. Sounds like it has some meaty brakes, but then the problem is that while it’ll stop you quick at lower speeds, at higher speeds you feel the car lurch but … you just don’t slow down much. You basically have to jam to brakes halfway to the floor, or more, if you’re going 80 and a truck pulls out a quarter mile in front of you going 20. I’m not joking. And that’s without any apparent brake fade.
The transmission … okay, everything online is telling me it’s a 6-speed automatic. It doesn’t behave like a 6-speed automatic. It behaves like a CVT with 6 "speeds" notched in. It’s unpredictable and nonlinear and doesn’t make sense. Do all new econoboxes do this? It has that classic "engine revs and transmission rumbles but the car hardly accelerates" feeling of a CVT, and the "once you’re near redline it seems to accelerate at the same RPM" feeling of a CVT, where it plays with the ratios on the fly.
Anyways, apart from that, its automatic programming sucks. It constantly short shifts and spits you into the highest gear possible, often even when you’re trying to go up hills, so then you slow down. Basically the only time it’s predictable is with your foot flat to the ground.
On the plus side, it has manual shifting mode, so I basically lived in manual shifting mode. Anything involving a hill or a speed over 75 prefers a manual shifting mode. It’s that bad. Eco, normal, or sport modes - doesn’t matter.
Gas tank is way too fucking small. I’m seeing, on the internet, a 14.2 gallon capacity and a 426 mile range. I cannot believe this. The on-board range estimator, even during the best cruising (55mph and fairly flat), never read more than a 350 mile range, though realistically, once you get down to about 100 miles, you’re dipping worryingly below 1/4 tank. At 1/4 tank, a full fillup was only 8-9 gallons. Whatever they’re claiming, if it’s not an outright lie, it’s a huge reserve for idiots that isn’t displayed by the fuel gauge or range estimator.
(And the range estimator was fairly accurate. I checked, often, because I couldn’t believe how bad the range was.)
So if you don’t want to run your tank dry in East Bumblefuck, this car gives you about a 250 mile range before you start to worry. Pretty fucking mediocre.
Handling. You want to know how a tall econobox handles? Shockingly well, if it doesn’t get upset. It understeers, though it really doesn’t have the power to push. It corners … really fucking flat, believe it or not. However, there was a big weasel word up there: "if it doesn’t get upset." See, this car gets upset more easily than a roided out drunk guy at a club who just got rejected by a girl he thought was beneath him. This car gets upset if you look at it funny. Brake a little too hard (so anything past like 5% brake pedal)? It gets upset. Transmission shifts? It gets upset. Tiny bump on one of the wheels? It gets upset. I’m serious. This thing lurches on every transmission shift except where you do it manually at the precisely correct time. If it shifts mid-turn, that’s enough to make you pucker up. So on perfect tarmac and at the perfect speed to go through a turn and in manual shift mode, it’ll slam turns far faster than any car like this should. Throw in a pebble and it bucks and moans.
Edit 2: Forgot to mention the infotainment. I did mention it has a backup camera. Okay. This is more good than bad, to be honest. It basically has the features you're really looking for: aux, USB (iphone / probably android), and bluetooth input. Two 12v outlets right there available neatly. Sound quality is fine. Look, it's nothing to write home about, but it is completely adequate. The only thing that bugged the shit out of me was the bluetooth. Basically, here's how I expect bluetooth to work. Turn it on, and it connects with any phones it recognizes. Failing that, it displays a code, you pull out your phone and punch it in, and it connects. This thing instead stores phones. It only has room for, what, six? After that, nobody else can connect. It also doesn't tell you this, at all. It's completely unclear and opaque that the user list is full, it just seems to not be working. You need to navigate the menu and figure out how to delete everyone else. Frankly, this is fine for you owning this car. If your friends want to play music, you better only have 5 friends. And for a rental car ... come the fuck on, Enterprise, clear out the list once in a while. I wonder how many complaints they get about bluetooth not working.
On the plus side, I put on 3100 miles and nothing broke, so there is that. Had 18xxx when I got it, so that’s expected, but we all know Kia’s reputation … which may not be entire true of late.
Of course, this car really is intended for cities. You know this because it just sucks driving it on highways or fast roads or up hill or through turns. In the city, though, it’s pretty small, so that’s great. I mean, it has horrible storage space, but whatever. It’s a city car. By virtue of being small and sucking on the highway.
I know, y'all are going to say I have expectations that are too high. I mean, yeah. But I'm not targeting this 'review' at soccer moms, I'm targeting it at car enthusiasts. So here you go.
